Terms of Service

1. Agreement & governing law
By creating an account or using Nabata ("the Service") at www.nabataa.com, you agree to these Terms. If you use Nabata on behalf of a restaurant or business, you represent that you have authority to bind that business. These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes are subject to the courts of Lagos State, Nigeria, unless mandatory law requires otherwise.
2. The Service
Nabata provides QR-based digital menus, guest ordering, staff floor queues, owner dashboards, and related tools for restaurants. Features and limits vary by plan (Free, Growth, Pro, Enterprise). We may update features with reasonable notice where practicable.
3. Accounts & acceptable use
You must provide accurate registration information and keep credentials secure. You may not abuse the Service, attempt unauthorized access, scrape guest data unlawfully, or use Nabata for illegal activity. We may suspend accounts that violate these Terms.
4. Plans, trials & billing
Free plan limits apply unless you subscribe. New restaurants may receive a 14-day Growth trial; when the trial ends without payment, the account returns to Free limits (no hard lockout of login). Paid plans (Growth, Pro) are billed in Nigerian Naira via Paystack on a monthly or yearly cycle. Yearly pricing charges ten months for twelve months of service (approximately two months free). Prices are quoted exclusive of VAT unless stated otherwise; applicable taxes may be added when required by law.
Subscriptions renew automatically until canceled. Cancellation takes effect at the end of the current paid period — you keep paid entitlements until that date. Failed payments may place the account in past-due status with a short grace period before demotion to Free. Enterprise pricing is agreed separately.
Refunds, if any, are handled case-by-case and communicated at purchase or via hello@nabata.app.
5. Guest payments
Guests pay restaurants directly (e.g. bank transfer). Nabata does not take custody of guest meal payments. You are responsible for accurate bank details and resolving payment disputes with guests.
6. Content & license
You retain rights to your menu, logos, and restaurant data. You grant Nabata a limited license to host and display that content to operate the Service. You must have rights to all content you upload.
7. Availability & liability
The Service is provided "as is." To the maximum extent permitted by Nigerian law, Nabata is not liable for indirect or consequential damages. Our aggregate liability for paid accounts is limited to fees paid for the Service in the three months preceding the claim.
8. Termination
You may stop using Nabata at any time. We may suspend or terminate for breach, abuse, or legal risk. On termination, Free-tier data retention follows our Privacy Policy.
